💰 15+ EMPLOYEES
Beginning January 1, 2023 under the new pay transparency bill CA employers with 15+ employees must:
- Post salary ranges in job descriptions (regardless if a job posting is posted using a third-party)
- Share wage range information with job applicants
- Share wage range information for an employee's position, when asked by an employee in that position
- Maintain job title and wage history records for each current employee and store the records for three years after employment has ended for possible inspection by the state’s labor commissioner who is tasked with determining "if there is a pattern of wage discrepancy"
- Submit pay data reports in a format that allows for the state to search and sort the information using readily available software
💰 100+ EMPLOYEES
California employers with 100+ employees MUST ALSO record and report:
- Pay data by race, ethnicity, and sex for the following job categories:
- Executive or senior-level officials and managers
- First- or mid-level officials and managers
- Professionals
- Technicians
- Sales workers
- Administrative support workers
- Craft workers
- Operatives
- Laborers and helpers
